Initiated by the buyer as an offer to purchase. Initial contract between the buyer and seller. In the 1999 case, McCarthy v. Tobin, the Massachusetts Supreme Judicial Court held that the Greater Boston Real Estate Board Offer to Purchase is an enforceable contract when signed by buyer and seller.
RIGHT TO SELL ADDENDUM
Agreement between a seller and real estate company which gives the listing company the exclusive right to market and sell the property for an agreed upon period of time, without MLS Addendum. For use with properties that are non-MLS listings or in conjunction with a separate grant of authority to post information on a multiple listing service.
